NOTICE IS HEREBY GIVEN that sealed Bids will be received in the City Administrative Office at the City/County Government Center (CCGC), 160 South Macy Street, P.O. Box 150, Fond du Lac, WI 54935, until 2 P.M. CST, Thursday, March 27th, 2025, at which time Bids will be publicly opened and read aloud in the City Manager’s Conference Room, 4th Floor of the CCGC. The project quantities include but are not limited to the following described approximate quantities of work:
Installation of a biosolids drying system and storage silo including a building addition to Structure 75, HVAC updates, new interior plumbing connections, new electrical room and lighting, rerouting of utility lines, pavement replacement, and related miscellaneous work. Installation of gas conditioning membranes and high-pressure compression including replacement of existing gas conditioning equipment, replacement of existing digester gas pipe, updated HVAC, a new renewable natural gas line to connect to the utility, and related miscellaneous work.

All Bids shall be prepared on the Bid forms provided in the Specifications and shall remain attached thereto, and shall be addressed to City of Fond du Lac, P.O. Box 150, Fond du Lac, WI 54935. Bids may not be delivered by facsimile transmission or other telecommunication or electronic means. Each bid envelope shall be properly identified on the face thereof “BID FOR 2025 BIOSOLIDS DRYING AND RENEWABLE NATURAL GAS (RNG) ADDITION, BID NO.2025-018”. No Bid shall be withdrawn for a period of (60) sixty days after the opening of said Bids, without the consent of the Deputy Procurement Officer. The City of Fond du Lac may reject any or all Bids on any basis and without disclosure of any reason. The failure to make a disclosure shall not result in accrual of any right, claim or cause of action against the City. The City also reserves the right to waive any formalities or informalities in bidding, and to select the Bid that, in its opinion, will best serve the interests of the City.
No Bid will be opened unless the “Bidder’s Proof of Responsibility” for 2025 is filed and approved at least (5) five days before the scheduled time for opening of Bids. Reference is made to Section 66.0901(2) and (3) Wisconsin Statutes. The Director of Public Works decision as to qualifications shall be final.

Each Bid shall be accompanied by a certified check or bank draft, payable to the City of Fond du Lac, or satisfactory Bid Bond, in the amount of 5% of the gross Bid as a guarantee that if the Bid is accepted as the successful Bid, such successful Bidder will execute and file the proposed Contract and Performance Bond within ten (10) days after Notice of Award of Contract.
Any Contract or Contracts to be awarded are expected to be funded with assistance from the Wisconsin Department of Natural Resources Clean Water Fund Program and is subject to all applicable State and Federal laws and regulations. Disadvantaged Business Enterprises (DBEs), including Women’s and Minority-owned businesses, are encouraged to submit bids for this Project. This Project will be designated as federal equivalency.
Bidders must demonstrate positive efforts to utilize DBEs. Failure to comply could result in disqualification of Bidder and termination of financial assistance or other sanctions. The successful Bidder will be required to conform to the wage requirements prescribed by the Federal Davis-Bacon and Related Acts. Bidders shall comply with President’s Executive Order 11246, Equal Employment Opportunity as amended
This agreement is for services related to a project that is subject to the Build America, Buy America Act (BABAA) requirements under Title IX of the Infrastructure Investment and Jobs Act (“IIJA”), Pub. L. 177-58. Absent an approved waiver, all iron, steel, manufactured products, and construction materials used in this project must be produced in the United States, as further outlined by the Office of Management and Budget’s Memorandum M-22-11, Initial Implementation Guidance on Application of Buy America Preference in Federal Financial Assistance Programs for Infrastructure, April 18, 2022.
